Iftekhar Mahmood, learned Additional Public Prosecutor appearing for the State, through Video conferencing.

Petitioner seeks regular bail in connection with Piro P.S. Case No. 30 of 2020, registered for the offences punishable under Section 392 of the Indian Penal code.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 11.11.2020 passed in Cr. Misc. No. 23629 of 2020 with liberty to renew his prayer for grant of regular bail after six months. Prosecution story is that two unknown motorcycle

Patna High Court CR. MISC. No.38315 of 2021(2) dt.25-08-2021 2/3 borne miscreants accosted the informant and snatched Rs.93,740/- from him and fled away.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR and he has been dragged in this case on the basis of confessional statement made by the petitioner in another case and also on the basis of recovery of a sum of Rs.2,000/- claimed to be looted money from his possession. Learned counsel for the petitioner further submits that neither the petitioner has been put on T.I. Parade nor the alleged looted money has been recovered from his possession and the petitioner is in custody since 07.02.2020. Regard being had to the submission made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 07.02.

2020 and the chargesheet has already been submitted and the trial is not likely to be concluded in near future due to Covid-19 pandemic and this is second attempt for grant of regular bail on behalf of the petitioner, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
