Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Section 420 of the Indian Penal Code. Allegation is that one Nazni sold her land to complainant and the consideration amount was paid to petitioners, who are brothers of Nazni, but they did not prepare any agreement with complainant and thus cheated him.
It has been submitted on behalf of the petitioners that they have falsely been implicated in the present case. There is no allegation of tampering of witnesses against petitioners. The matter relates to civil dispute. The complainant has not filed any Title Suit for redressal of his grievance. With malafide intention the present prosecution has been instituted against petitioners. On behalf of the State, it is submitted that petitioners are named in the complaint case.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.50282 of 2016 (2) dt.23-11-2016 2/2 above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Darbhanga, in connection with C.R. no. 49 of 2015, T.R. no.1191 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
