JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 27-02-2017 It is submitted by the learned counsel for the State that due to inadvertence counter affidavit of C.W.J.C. No. 8284 of 2015 has been filed in the present case.

2. In view of the submission made above, learned counsel for the State is permitted to make correction in the aforesaid counter affidavit in the course of the day.

3. The Registry is also directed to place the aforesaid counter affidavit on the record of C.W.J.C. No. 8284 of 2015 forthwith.

4. The present writ application has been filed by the

Patna High Court CWJC No.8274 of 2015 dt.27-02-2017 2 / 2 petitioner for a direction to the respondent authorities to pay all retiral benefits, i.e., provident fund, pension and interim relief to the petitioner.

5. Despite repeated calls, nobody appears on behalf of the petitioner to press the application.

6. A counter affidavit has been filed on behalf of respondent no.5, the District Programme Officer (Establishment), Samastipur, wherein it has been stated that the department has already paid all the retiral dues of the petitioner through different heads.

7. Learned counsel for the State submitted that the arrear of pension, unutilized earned leave and provident fund amount has already been credited to the account of the petitioner.

8. Regard being had to the submissions made above, the writ application is disposed of.
