JUSTICE SANJAY PRIYA ORAL ORDER 28-11-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Saharsa Rail P.S. Case No. 25 of 2017 instituted for the offence under Sections-384/34 of the Indian Penal Code.
It is alleged in the written report that one Video Clip got viral, showing both the petitioners extorting illegal money from the fruit vendor and keeping the same in their pockets. The informant has stated in the written report that he watched the video clip along with other police personnel and identified these persons as petitioners. Learned counsel for the petitioners has submitted that petitioners have been falsely implicated in this case by the informant who is inimical to the petitioners. There is no material in the case diary against them and no case for the offence under Section 384 IPC is made
Patna High Court Cr.Misc. No.51282 of 2017 (3) dt.28-11-2017 2/2 against them. In paragraph-3 of the petition, it has been mentioned that the petitioners have no criminal antecedent.
In such circumstances, this application stands disposed off with a direction to the petitioners to surrender before the trial court and seek regular bail in terms of the order dated 16.09.2017 passed by the learned Sessions Judge, Khagaria in A.B.A. No. 633 of 2017 (Sanjay Priya, J) sushma/- U T
