The petitioners are apprehending their arrest in connection with madhepura (Mahila) P.S.Case no.11 of 2017 registered for offences punishable under Sections 341, 323, 394, 379 and 504/34 of the Indian Penal Code.
Allegation against the petitioner No.1 is that he along with the other co-accused tried to administer cow dunk to the informant and against the petitioner no.2 there is allegation of taking away Rs.2,000/- and the paper of the land.
Submission of the learned counsel for the petitioner is that there is delay of eight days in lodging the case and no specific allegation has been attributed against them.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.24307 of 2018 (2) dt.03-05-2018 2/2 Having heard both sides. Petitioner no. 2 (Goughi Devi @ Gouri Devi) is a lady, as such let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Madhepura in connection with Madhepura (Mahila) P.S.Case No.11 of 2017 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
So far petitioner no.1 (Rupesh Yadav @ Rupesh Kumar) is concerned let the petitioner no.1 surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
