JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-05-2016 Heard counsel for the petitioner and Mr. R.S. Pradhan Sr. Advocate for the respondent nos. 4 to 8. The petitioner is the widow of late Shambhu Sharan Singh who was an erstwhile employee of the Bihar State Scheduled Caste Co-operative Development Corporation Limited ( for short 'the Corporation').

The writ application prays for payment of death - cum-terminal benefits.

Patna High Court CWJC No.1841 of 2015 (2) dt.09-05-2016 A counter affidavit is filed on behalf of the Corporation explaining the reasons in which such claim is not sustainable. However, in para 12, it has been stated that with respect to the deposits in the EPF account of the deceased employee a communication has been made to the Organization as well as the petitioner.

The counsel for the petitioner in the light of the statement made in para 12 of the counter affidavit, states that the petitioner would ventilate her grievance with regard to the payment of the EPF amount as well as pension under the scheme before the appropriate /competent authority of the Employees Provident Fund Organization.

Considering the above, the writ application stands disposed of granting the said liberty to the petitioner. (Kishore Kumar Mandal, J) Shyam/- U
