The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363/34 of the Indian Penal Code.
As per written report, the daughter of the informant namely Prity Kumari aged about16 years has been kidnapped by the petitioner.
It has been submitted on behalf of the petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. He submits that the statement of the victim girl under Section 164 of the Cr.P.C. has been taken where she has stated that she has not been kidnapped by any other and she got married with the petitioner. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Danapur in connection with Khagaul Police Station Case No. 90 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
