Counsel for the petitioner submits that the present criminal writ application has been filed for quashing the impugned first information report bearing Lakhnaur P.S. Case
Patna High Court CR. WJC No.789 of 2021(2) dt.04-04-2023 2/2 No. 289 of 2019, dated 23.11.2019, lodged under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. Counsel for the petitioner submits that the petitioner is innocent and has committed no interpolation in the marks-sheet bearing Roll Code 44, Roll No. 108, date of birth 05.04.1976, marks obtained 486, certificate no. 186170 from Bihar Sanskrit Shiksha Board. Counsel for the State submits that from the contents of the first information report, it transpires that the petitioner had appeared in examination of Madhyama in the year 1988 bearing Roll Code 13, No. 77, certificate no. 001477, dated 10.03.1962, and obtained 465 marks and she again appeared in 1990 in the same exam and this time indicated her date of birth as 05.04.1976, which is a fraud.
In the above facts and circumstances, it transpires to the Court that offences are constituted from the contents of the first information report, therefore, this Court is not inclined to interfere and present writ petition is hereby dismissed. (Dr. Anshuman, J) Shamshad/- U T
