The petitioner filed this Criminal Miscellaneous for modification of the order dated 22.06.2016 passed in Cr. Misc. No.8264 of 2016 by which the petitioner was granted anticipatory bail in Chandramandih P.S. Case No.46/2015 on the ground that the petitioner could not surrender within the stipulated period on account of his illness.

However, after some argument, learned counsel for the petitioner seeks permission to withdraw this modification petition. Prayer is allowed.

This modification petition is dismissed as withdrawn. However, if the petitioner is directed to surrender in the court below within three weeks from the date of receipt of copy of

Patna High Court Cr.Misc. No.30352 of 2018 (2) dt.05-09-2018 2/2 this order and pray for regular bail the learned court below shall consider the regular bail of the petitioner, taking into consideration that the petitioner was granted anticipatory bail and dispose of the bail petition preferably on the same day.
