The petitioners are languishing in custody for the offence punishable under Sections 307, 379, 341, 323, 324, 504, 506, 147 and 149 of the Indian Penal Code.
Petitioners Nikku Jha and Ravishankar Jha allegedly gave dagger blow to Yogi Kumar, the son of the informant. The doctor has found two incised wounds at the fore arm, one incised wound at the index finger, three incised wounds at the
Patna High Court CR. MISC. No.28131 of 2020(3) dt.27-01-2021 2/3 chest besides other incised wounds below nose and right anterior chest. Petitioners are in custody since 22.05.2020. Considering the nature of allegation against the petitioners Nikku Jha and Ravishankar Jha, I am not inclined to enlarge them on bail for the present in connection with Birupur P.S. Case No. 22 of 2020.
Hence, their prayer for bail is refused.
They may renew prayer for bail, if no progress takes place in the trial for next nine months.
Petitioner Amit Kumar Jha @ Amit Kumar has allegedly caused injury with brick, hence let him be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Birupur P.S. Case No. 22 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner Amit Kumar Jha shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner Amit Kumar Jha.
