The petitioner seeks pre-arrest bail in connection with Rahui P.S. Case No. 233 of 2017 registered under Sections 379 of the Indian Penal Code and Sections 4/40 of the Bihar Minor Mineral Concession Rule 1972 and 8(d) of the Bihar Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2003.
Considering the fact that the petitioner was involved in illegal sand mining and when the police intercepted the
Patna High Court Cr.Misc. No.51503 of 2017 (3) dt.19-12-2017 loaded tractor, he ran away, I am not inclined to grant him pre-arrest bail. The application is rejected. In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
