JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 12-05-2016 Heard Ms. Mazumdar for the petitioner, the counsel for the State and respondent- Accountant General. Petitioner having served the respondent as Cooperative Extension Officer retired on 28.2.1997. Pension was fixed and was payable to him w.e.f. 01.03.1997. On account of revision in the pay scale it is stated that the pension of the petitioner merits to be revised w.e.f. 01.04.1997 to 31st of March, 2007 and thereafter again w.e.f. 01.04. 2007 till date. The respondents have not done so and hence the application. A counter affidavit on behalf of the respondent no.3 is filed.
Patna High Court CWJC No.6543 of 2015 (2) dt.12-05-2016 2/3 Mr. Priyadarshi counsel for the respondents draws attention of the Court to averments made in paragraph nos. 5 and 6 which state as under:- "5. That in the instant writ petition the petitioner retired as a cooperative extension office holder of P.P.O. no. 304940 has filed a writ petition in Hon'ble High Court, Patna for making payment of half of the grade pay with pensionary benefit to the petitioner in term of clause 2 (v) and clause 5 of resolution contained in memo no. 820 dated 23.09.2009 and further amended by memo no. 1285 dated 18.12.2009 and memo no. 119 dated 08.02.2010.
In this connection this respondent office has written a letter to T.O. Darbhanga vide letter no. Pen-14-Gen-51719, dated 29.06.2015 and requested to consolidate the amount of pension in respect of the petitioner in the light of finance department resolution no.
dated 23.09.2009 and the copy endorsed to the concerned department.
6. That it is submitted that the Treasury Officer, Darbhanga has also taken steps and requested the concern Bank (State Bank of India) for payment of pension including D.A. and Medical allowance and also for consolidation of pension with effect from 01.04.2007. The request letter was issued vide memo no. 567 dated 15.09.2015 and a copy of same has been forwarded to the petitioner also."
It does appear that the grievance of the petitioner has been addressed by the respondents inasmuch as all needful/required steps for authorizing pension in revised pay scale
Patna High Court CWJC No.6543 of 2015 (2) dt.12-05-2016 3/3 have been ordered by the Accountant General.
Seen thus, in my view, the writ application has become infructuous. It is, accordingly, disposed of as such. (Kishore Kumar Mandal, J) Shyam/- U
