JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-10-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Rail (Darbhanga) Police Station Case No. 15 of 2014, disclosing offences under Sections 395, 397 and 412 of the Indian Penal Code.

Learned Counsel for the petitioner has submitted that petitioner's implication is based merely on the disclosure made by a co-accused before the police in course of investigation, which does not have any evidentiary value.

The said submission has not convinced me for the purpose of grant of anticipatory bail considering the gravity of the offence and the fact that the petitioner is an

Patna High Court Cr.Misc. No.42061 of 2016 (2) dt.03-10-2016 2/2 accused in another case registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

This application for anticipatory bail, is hereby, rejected.

The petitioner, Pujan Singh @ Shiv Pujan Singh, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
