JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Mansoorchak P.S. Case No. 60 of 2017 registered under Sections 376 and 511 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there is no truth behind the allegations made in the first information report. It is further submitted that even if the allegations are believed to be true, ingredients of the offence punishable under Sections 376/511 of the Indian Penal Code are completely wanting. It is further submitted that in course of

Patna High Court Cr.Misc. No.29919 of 2018 (2) dt.18-05-2018 investigation, the petitioner had fully co-operated. He had appeared before investigating officer after receiving notice under Section 41A of the Code of Criminal Procedure. It is also contended that the petitioner has got no criminal antecedent and having got roots in the society he is not likely to abscond or tamper with the evidence.

Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Having regard to the submissions made on behalf of the parties as also the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Begusarai in connection with Mansoorchak P.S. Case No. 60 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
