22. 11.2022 (Annexure-P-5 in this writ petition) passed by the District Officer Cum President, District Compassionate Committee, Buxar and the same communicated Vide Memo No. 012327/Est. Buxar, dated 24. 11. 2022, whereby and whereunder, duly submitted application for appointment on the post of Chaukidar, Anchal Office, Buxar on the compassionate ground has been illegally, erroneously, unreasonably and arbitrarily rejected and stated there, the petitioner

(ii). This Hon'ble Court may be pleased to issue an appropriate direction to the District Officer Cum-President, District Compassionate Committee, Buxar that the petitioner may be appointed on the post of Chaukidar under Circle Office, Buxar in place of Chaukidar late Sudarshan Singh Yadav.

(iii). The impugned order as contained Annexure -P-5 of the writ petition under the facts and circumstances is otherwise illegal, erroneous unreasonable and arbitrary and fit to be set aside by this Hon'ble High Court.

At the outset, the learned counsel for the petitioner submits that the petitioner be granted liberty to approach the Respondent authorities for grant of compassionate employment, after obtaining a declaration from the competent authority / Civil Court having appropriate jurisdiction, regarding the petitioner being an adopted son of late Sri Sudarshan Singh Yadav and Smt. Geeta Devi. Liberty, so sought, is granted. 3.
