JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Barauni (Chakia O.P.) P.S. Case No. 450 of 2015 for the offences instituted under Sections 366(A)/34 of the Indian Penal Code.
The allegation against the petitioners is of abducting the victim girl, as the petitioners and the victim girl were seen near Rajendra Pool Tempo Stand.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. They have falsely been implicated in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. The victim
Patna High Court Cr.Misc. No.54927 of 2016 (2) dt.22-12-2016 2/2 girl has been examined under Section 164 of the Cr.P.C., where she has made specific allegation against one Chandraprakash @ Nepali. In respect to the petitioner no.1, it has been said that when she saw the victim, she took the victim to her paternal home. As far as petitioner no.2 is concerned, no accusation has been made against him by the victim girl.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Barauni (Chakia O.P.) P.S. Case No. 450 of 2015 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
