2. The petitioner is in custody in connection with Patepur P.S Case No. 209 of 2023 registered for the offences punishable under Section 392 of the I.P.C.

3. As per prosecution case, the allegation against three unknown miscreants is that they boarded on a motorcycle came and on the gun point snatched the informant's motorcycle, purse, three ATM cards, other documents, mobile and cash of Rs.10,000/- from the informant and fled away.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Petitioner is not named in

Patna High Court CR. MISC. No.33967 of 2024(2) dt.21-05-2024 2/2 the F.I.R. His name transpired from the confessional statement of other co-accused. Nothing has been recovered from his conscious possession. No T.I.P. was conducted during investigation. The other co-accused namely, Abhishek Kumar has already been granted bail by this Court vide order dated 24.04.2024 passed in Cr. Misc. No. 30332 of 2024. Moreover, petitioner is in judicial custody since 09.10.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order and also considering the aforesaid facts and circumstances of the case and submission made on behalf of the petitioner, let the above named petitioner be released on bail after framing of the charge on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M./Incharge Court C.J.M., Vaishali atHajipur in connection with Patepur P.S Case No. 209 of 2023.
