The petitioner seeks bail in a case registered under Sections 341, 323, 325, 307, 354, 504, 427, 379/34 of the Indian Penal Code. Later on Section 302 of I.P.C. has been added. Allegation is that the accused persons including the petitioner assaulted the informant's father and when her mother came to save him they also assaulted her and threw her on the ground and snatched golden baali and jitiya. The accused persons threw informant's father from the roof, as a result of which his father became badly injured and he was taken to the Hosptial for treatment. In course of treatment, his father died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.05.2018 and has got no

Patna High Court CR. MISC. No.26070 of 2019(3) dt.01-07-2019 2/2 criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Both the parties are agnates. Due to petty reasons the alleged occurrence is said to have taken place. No specific over act is alleged against the petitioner. General and omnibus allegation has been made.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge III, Gaya in connection with Sessions Trial No.547 of 2019 arising out of Wajirganj P.S. case No.28 of 2017.
