Heard learned counsel for the petitioner and learned A.P.P for the State.

Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 30(a) and 37(b) and Sections 25(1-b)a, 26 and 35 of the Arms Act. Allegation is of recovery of 500ml (12 pouches) country-made liquor from the motorcycle and 5 live cartridges from the pocket of the petitioner.

Patna High Court CR. MISC. No.28939 of 2022(3) dt.28-09-2022 2/2 Learned Counsel for the petitioner submits the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner was not arrested on spot, he was arrested while he was going to his house. Further, it is submitted that the petitioner is in custody since 16.03.2022, charge-sheet has been submitted in the case and he has one criminal antecedent.

Learned A.P.P for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court-2, Nawada in connection with Roh P.S.
