The petitioner is languishing in custody for the offence punishable under Sections 304B and 201/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. The unnatural death of the victim took place in the house of the petitioner and there is allegation of demand of a four wheeler as consideration of marriage. Other witnesses have also supported the allegation of demand of dowry and torture for the same during the investigation of the case. Petitioner is in custody since 14.02.2020.

Considering the nature of allegation and presumption

Patna High Court CR. MISC. No.28134 of 2020(3) dt.27-01-2021 2/2 of law against the petitioner, I am not inclined to enlarge the petitioner on bail for the present in connection with Tisiauta P.S. Case No. 38 of 2018.

Hence, prayer is refused.

Petitioner may renew prayer for bail, if the trial is not concluded within nine months.
