JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 341, 323, 504, 308 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the only allegation against the petitioner is that he assaulted the informant by means of lathi, causing no serious injury and other co-accused of this case has already been granted the privilege of bail by this Court vide order, dated 09.09.2015, passed in Criminal Miscellaneous No. 36331 of 2015.

Heard learned A.P.P. also.

Considering the submission, as above and the fact that

Patna High Court Cr.Misc. No.45415 of 2016 (2) dt.15-12-2016 2/2 petitioner is a lady and she has no criminal antecedent, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui P.S. Case No. 170 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
