Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. On a Bolero vehicle other accused persons were found in possession of firearm whereas the petitioner was driver of the vehicle. Suspicion was raised that they were making preparation to commit dacoity.
Submission is that petitioner has got no criminal antecedent. He had no knowledge as to what was in possession of other co-accused. Petitioner is in custody since 14.02.2019. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.26340 of 2019(2) dt.23-04-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Chakia Police Station Case No. 40 of 2019, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
