JUSTICE SANDEEP KUMAR ORAL ORDER 11-09-2025 Heard the learned counsel for the petitioner, learned APP for the State and the learned counsel for the informant.
2. The petitioner seeks regular bail in connection with Bihiya P.S. Case No. 01 of 2025 registered for the offence under Sections 137(2), 142 of the Bharatiya Nyaya Sanhita, 2023 and Section 12 of the POCSO Act.
3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 10.03.2025. He further submits that the victim girl in her statement recorded under Section 183
Patna High Court CR. MISC. No.29613 of 2025(4) dt.11-09-2025 2/2 B.N.S.S., has not alleged any illegal act by the petitioner.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances as well as the period of custody, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Bhojpur at Ara in connection with Bihiya P.S.
