2. Petitioner seeks bail who is in custody since 08.03.2026 in connection with Cyber P.S. Case No. 14 of 2026, F.I.R. dated 07.03.2026 for the offences punishable under Section 318(4) of the BNS, 2023 and Sections 66C/66D of the I.T. Act, 2000.

3. According to prosecution case, this petitioner is using his bank account as Mule account for committing cyber fraud.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed

Patna High Court CR. MISC. No.27165 of 2026(2) dt.21-04-2026 2/2 any offence as alleged in the FIR. As per the allegation in the FIR the amount in question has been withdrawn from teh ATMs in the State of Jharkhand.

Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that in the bank account of the petitioner bearing account no. 8101775125, altogether Rs. 8,62,006/- (Rs. Eight lakh, sixty two thousand and six) has been credited in his bank account between 06.08.2025 and 17.12.2025. It is evident that the said bank account belong to the petitioner and he is account holder of a Mule Account and out of Rs. 8,62,006/- , Rs. 8,24,472/- was withdrawn through ATMs from the bank account of the petitioner.

6. Considering the aforesaid facts and circumstances that the petitioner was involved in the present cyber crime, I am not inclined to enlarge the petitioner on bail in connection with Cyber P.S. Case No. 14 of 2026 pending in the court of learned Judicial Magistrate-1st Class, Sheikhpura.

7. Prayer is refused.
