JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 The petitioner is apprehending his arrest in connection with Khaira P.S. Case No. 122 of 2017, registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code. Petitioner is the husband of the deceased and allegation is of demand of dowry and causing death of the deceased upon non fulfillment of the said demand.

No one appears on behalf of the petitioner in spite of repeated calls. However, learned counsel for the State as well as learned counsel for the Informant are present, who have opposed the prayer for bail on the ground that there is direct and specific allegation against the petitioner of strangulating the deceased to death.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.31798 of 2018 (4) dt.27-06-2018 2/2 circumstances of the case and nature of accusation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is accordingly dismissed.
