07-10-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Rajapakar P.S. Case No. 264 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, co-accused Chandan Kumar abused the informant and thereafter, he assaulted him by butt of pistol. It is further alleged that on the order of co-accused Bhavani Singh, this petitioner and co-accused Chandan Kumar fired from their pistol, however; it did not hit informant. It is submitted on behalf of petitioner that specific allegation of abuse and assault is against co-accused Chandan Kumar. So far as this petitioner is concerned, though there is

Patna High Court CR. MISC. No.24574 of 2020(2) dt.07-10-2020 2/2 allegation of firing, but no injury was caused to the informant. It is stated in paragraph - 3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 264 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
