2. The petitioner is apprehending arrest in connection with Bannubagicha P.S. Case No. 03 of 2023, dated 16.05.2023, lodged under Section 323, 341, 307 and 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against five named accused persons, including the present petitioner. It has been alleged that all the accused, under the stage of intoxication, assaulted the informant and his mother, as a result of which the petitioner's mother sustained injuries.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is further submitted that, from the allegations made in the FIR, the

No.30695 of 2025(2) dt.15-05-2025 2/2 ingredients of Section 307 of the Indian Penal Code are not made out, and it has been stated that the incident occurred under intoxication. Counsel also submits that the petitioner does not have clean criminal antecedents, as two criminal cases are pending against him.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate, Lakhisarai, in connection with Bannubagicha P.S. Case No. 03 of 2023, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
