The appellant who happens to be co-villagers of the informant along with others, armed variously came to the informant who was standing near the house of Kumar Saheb (Wakil) alongwith Raj Kumar Mahto and began to fire, on account thereof, both of them sustained firearms injury. All the accused have been specified by name and parentage by the respective injured also.

The case has been registered under section 307 including other allied sections of IPC as well as under S.C., ST (POA) Act out of which, section 307 prescribes sentence up to imprisonment for life and on account thereof, Section 3(2)(V) read with section 6 of the SC/ST (POA) Act is found applicable whereupon, the instant appeal, in form of anticipatory
