2. The petitioners has prayed for bail in a case instituted for the offence under Sections 302 and 201 of the Indian Penal Code.

3. As per allegation in the FIR, an un-known dead body was recovered lying in the field and on the basis of information given by Chaukidar, FIR was registered. Deceased's wife was arrested and she confessed her involvement in the crime and she also disclosed the name of the petitioner as one of the associates.

4. It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.33500 of 2024(2) dt.16-05-2024 2/2 that petitioners have been falsely implicated in this case. General and omnibus allegations have been levelled against the petitioners. They have committed no offence. Only on the basis of suspicion, their names have been dragged in the present case. No one is the eye witness of the alleged occurrence. Wife of the deceased (co-accused) has already been enlarged on bail by this Court vide order dated 21.3.2024 passed in Cr. Misc. No. 21.3.2024. Petitioners have got no criminal antecedent and languishing in judicial conditions since 20.10.2023.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar in connection with Falka P.S. Case No. 212 of 2023.
