2. The petitioners apprehend their arrest in connection with Kusumbha P.S. Case No. 12 of 2026, instituted under Sections 191(2), 190, 126(2), 115(2), 109, 118(2), 117(2), 303(2), 352 of the B.N.S.

3. As per the prosecution case, on 25.01.2026 when the informant went to his farm, he saw that co-accused Mohan Bind and Sugar Bind were selling liquor on his farm. On protest, Mohan Bind assaulted him with bicycle chain causing head injury to him. When the brother of informant came to save, petitioners along with F.I.R. named accused persons brutally

Patna High Court CR. MISC. No.31682 of 2026(2) dt.07-05-2026 2/3 assaulted them. It is alleged that co-accused Manish Bind snatched the golden chain from the neck of informant's brother.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties. Some scuffle took place between the parties in which both the parties sustained injuries. Petitioners were alleged as members of mob and there is no specific allegation against the petitioners. Petitioners are aged about 25 year and 19 year having no criminal antecedent. Petitioners undertake to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case, submission of learned counsel for the parties and clean antecedent of the petitioners, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Kusumbha P.S. Case No. 12 of 2026, subject to the conditions laid down in Section
