The petitioner apprehends his arrest in connection with Panapur P.S. Case no. 78 of 2016, registered under Section 379 of the Indian Penal Code.
Regarding the theft of motorcycle of the informant Rajendra Ram, Panapur P.S. Case No. 78 of 2016 instituted under Section 379 of the I.P.C. against unknown. Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner is not named in the F.I.R. in course of investigation the name of the petitioner has come in the confessional statement of co-accused Hari Kishore Prasad, except that nothing has been collected by the I.O showing the hands of the petitioner in the alleged theft of
Patna High Court Cr.Misc. No.29013 of 2018(2) dt.09-05-2018 2/2 motorcycle of the informant. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-IV, Saran at Chapra in connection with Panapur P.S. Case No. 78 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
