JUSTICE SHIVAJI PANDEY ORAL ORDER 18-05-2018 Heard learned counsel for the petitioners and learned counsel for the State as well as North Bihar Power Distribution Com. Ltd.
The petitioners seek anticipatory bail in a case instituted for the offences under Sections 420/34 of the Indian Penal Code.
As per allegation, the petitioners through Munna Tiwari and Prem Tiwary has extracted Rs.200 to Rs. 700 from each consumer for providing the electric connection and for that an FIR has been lodged by the Junior Engineer.
Learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.30213 of 2018 (2) dt.18-05-2018 petitioners would deposit Rs.17,400/-, as mentioned in the FIR, in the court below. He has further submitted that petitioners will deposit the said amount within two weeks from today. If the petitioners deposit the said amount within the aforesaid period, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Mahfooz Ansari and Qeyamuddin Ansari, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-14, East Champaran in connection with Sangrampur P.S. Case No.204 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that if the petitioners will not co-operate during course of investigation and join for interrogation the police will be at liberty to file an application for cancellation of bail.
