2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 342, 323, 353, 420 504 of the Indian Penal Code.

3. On the alleged date and time of occurrence all the F.I.R named accused persons including this petitioner made the informant hostage about four hours and misbehaved and abused him.

4. It is submitted that petitioner has been made accused in this case due to dirty village politics. The specific allegation is against other co-accused persons. There is no specific overt act is attributed against this petitioner. There is 3

Patna High Court CR. MISC. No.30771 of 2023(2) dt.20-07-2023 2/2 days delay in lodging the case for which there is no plausible explanation which itself creates doubt over the veracity of the prosecution case. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 2 nd Exclusive Special Excise Court,l Saran at Chapra in connection with Bheldi P.S. case no 61 of 2010, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
