Petitioner seeks bail in connection Ara Town P.S. Case no. 42 of 2021 registered for the offence punishable under sections 20(B)(ii)(b), 29 of the NDPS Act.

Learned counsel for the petitioner submits that petitioner is in custody since 14.1.2021, is person with clean antecedent and charge sheet has been submitted. Allegation is recovery of 1.5 kg Ganja from the house of the petitioner. Learned counsel for the petitioner submits that admittedly alleged recovery is little more than small quantity but much less than commercial quantity.

Learned APP opposes the prayer for bail.

Considering the facts that petitioner is in jail custody

Patna High Court CR. MISC. No.38232 of 2021(2) dt.13-12-2021 2/2 since 14.1.2021, is person with clean antecedent and charge sheet has been submitted and allegation of recovery of Ganja which is little more than small quantity, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Bhojpur, Ara in NDPS Case no. 4/2021 arising out of Ara Town P.S.
