This application for grant of anticipatory bail arises out of Natwar P.S. Case No. 02 of 2016, disclosing offences under Section 366A of the Indian Penal Code.
From the First Information Report, it appears that the allegation is against co-accused Guddu Lal who is said to have kidnapped the victim. The petitioner is father of said Guddu Lal. It is alleged in the First Information Report that petitioner also played some role in the said kidnapping.
Learned counsel appearing on behalf of the petitioner has submitted that there is absolutely nothing in the First Information Report to constitute an offence under Section 366A
Patna High Court Cr.Misc. No.41118 of 2016 (3) dt.03-10-2016 2/2 of the Indian Penal Code, so far the present petitioner is concerned and he has been implicated only because he is father of main accused Guddu Lal.
Considering the submissions as above, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bikramganj, Rohtas at Sasaram in connection with Natwar P.S. Case No. 02 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
