The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in connection with Raniganj P.S. Case No. 49 of 2020, registered under sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

As per allegation in the FIR, the four accused persons including the petitioner herein assaulted the informant with farsa on his head.

It is submitted by learned counsel for the petitioner that from perusal of the injury report of the informant which was called for and has been received, it would transpire that out of the four injuries, two are swelling, the third is the complaint of pain in vertex and the fourth injury is stated to be a lacerated

Patna High Court CR. MISC. No.24671 of 2020(4) dt.12-01-2021 2/2 wound on temporal region, which in the opinion of the doctor is simple in nature. It is submitted that the injury report does not support the allegation made in the FIR. The petitioner has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the submissions made on behalf of the petitioner and the petitioner not having any criminal antecedent, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of eight weeks from today and in the event of his arrest or surrender in connection with Raniganj P.S. Case No. 49 of 2020, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Araria subject to the condition as laid down under section 438(2) of the Cr.P.C.
