JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State through Video conferencing.
Petitioners apprehend their arrest in a case registered for the offence punishable under Section 323 and other allied sections of the Indian Penal Code.
Informant alleges that when the police party was trying to pacify the dispute between two groups of different caste, petitioners and other accused persons pelted stones on the police party injuring some of the police men including a
Patna High Court CR. MISC. No.24635 of 2020(2) dt.08-10-2020 2/2 constable Mukesh Kumar who sustained injury on his head. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to dirty village politics. There is a case and counter case and there is no specific allegation against the petitioners. Instant case has been lodged against 15 named and about 40 to 50 unknown persons.
Considering the facts of the case, in the event of arrest/surrender, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Sahiyara Police Station Case No. 52 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
