The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, a total of thirteen accused persons including the petitioner herein are said to have came variously armed with lathi, rod etc. and assaulted the informant and others.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in the case. The allegations are general and omnibus in nature. There is a case and counter case between the parties. Coaccused

Patna High Court CR. MISC. No.39037 of 2021(4) dt.13-01-2022 2/2 Pankaj Yadav has been enlarged on bail vide order dated 18.11.2021 passed Cr. Misc. no.22211 of 2021. He is in custody since 5.2.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the general and omnibus allegation against the petitioner, grant of bail to coaccused Pankaj Yadav and the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Dhoraiya P.S. Case no. 80 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
