2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 354, 328, 452, 354(B)/34 of the Indian Penal Code.
3. According to F.I.R., allegation against the petitioner is that he outraged the modesty of granddaughter of the informant and forcibly administered poison to her.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to petty dispute over the boundary. He next submits that though the alleged occurrence took place on 28.12.2023 but F.I.R. has been lodged on 04.01.2024, after inordinate delay of 6 days without any plausible explanation for the same. Considering the backdrop of the case, delay in lodging the F.I.R. and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Rosera, Samastipur in connection with Singhiya P.
