The petitioner apprehends his arrest in Pakridayal P.S. Case No.255 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The recovery was made from the house of Shiv Prakash Paswan. The informant alleged that the petitioner was also found fleeing away from the place of occurrence. The name of the petitioner surfaced in the case in confessional statement of Shiv Prakash Paswan from whose house the liquor was recovered.
It appears that nothing has been recovered from the house of the petitioner. The recovery was made from the house of Shiv Prakash Paswan.
Having considered the facts aforesaid, the petitioner,
Patna High Court CR. MISC. No.28190 of 2020(2) dt.03-12-2020 2/2 above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran at Motihari in connection with Pakridayal P.S. Case No.255 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U T
