The petitioners apprehend arrest in Complaint Case No.532 of 2016, instituted for the offence under Sections 323,354,504/34 of the IPC.
Learned counsel for the petitioners submits that petitioner no. 1 is devar of the complainant. In the written report, it is alleged that petitioner no. 1 entered into the courtyard of the complainant, and attempted to commit illegal act with her. Petitioner no. 2 and 3 are son and wife of petitioner no. 1.
From the S.A. of the complainant which is available
Patna High Court Cr.Misc. No.28542 of 2018(2) dt.18-05-2018 2/3 with the complaint petition, it appears that she has leveled general and omnibus allegation against the petitioners. She has mentioned in her S.A. that petitioner no. 1 is her devar and both are living in the same house.
In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioners, named above, in the event of their arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 532 of 2016, to the satisfaction of the learned Sub Divisional Judicial Magistrate, Madhepura, subject to condition as laid down u/S 438 (2) of the Cr. P.C.
