====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-11-2020 Heard Mr. Umesh Chandra Verma, learned counsel for the petitioner and Md. Aslam Ansari, learned APP for the State.

The petitioner seeks bail in connection with Chiraiya P. S. Case No. 506 of 2019 dated 30.10.2019, instituted for offence under Section 395 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though he is named in the F.I.R. but only on the asking of the informant who has named the petitioner along with one Dhiraj Gupta. The petitioner was not arrested on the spot but only after five days and

Patna High Court CR. MISC. No.25276 of 2020(3) dt.09-11-2020 2/3 from his possession Rs. 12,000/- is said to have been recovered. The amount of recovery is claimed by the petitioner to be his own. According to paragraph 3 of the bail petition, the petitioner has earlier been made accused in five cases, but as noted he is on bail in three of such cases.

In the present case, the petitioner is in custody since 05.11.2019.

Regard being had to the nature of accusation and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Chiraiya P. S. Case No. 506 of 2019.

However, it is made clear that the petitioner shall participate in the trial and his unauthorized absence from trial proceedings would render his bail liable to be
