JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-12-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Riga P.S. Case No. 192 of 2015 registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that on 03.07.2015, Dahaur Rai, neighbour of the informant, started to construct the house in front of his door then his wife made protest. Thereafter, Dahaur Rai started abusing the wife of the informant, then his both sons came out from the house and Dahaur Rai ordered to kill his son, Jai Prakash Rai. In that course, the petitioners gave knife blow to his son causing injury at his head, chest and finger of left hand.

Patna High Court Cr.Misc. No.52839 of 2016 (2) dt.07-12-2016 2/2 Learned counsel appearing on behalf of the petitioners submits that in fact, the occurrence took place due to land dispute, in which petitioner no.1 and his father Dahaur Rai also sustained injury, regarding which Riga P.S. Case No. 205 of 2015 is instituted on the basis of the written report of petitioner no.1 Chunchun Rai. Moreover, the injuries, as found on the person of Jai Prakash Rai, are found simple in nature. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Sitamarhi in connection with Riga P.S. Case No. 192 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
