JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2020 Heard learned counsel for petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Raniganj P.S. Case No. 307 of 2011 registered for the offence under Sections 376, 504/34 of the Indian Penal Code.

As per the prosecution case, on 24.11.2011, while the prosecutrix was alone in her parental house this petitioner is alleged to have caught informant and committed rape. It is submitted on behalf of the petitioner that this petitioner is innocent and has been falsely implicated in this case and in medical examination of the informant the Doctor has not found any sign of rape upon the informant and ascertained her age 17 to 18 years old which falsify the prosecution case. It is stated in paragraph-3 the petitioner has got clean antecedent.

Patna High Court CR. MISC. No.24656 of 2020(2) dt.08-10-2020 2/2 Considering allegation attributed against the petitioner being of serious nature, I am not inclined to grant anticipatory bail. Hence anticipatory bail prayer of the petitioner stands rejected.
