The petitioner seeks regular bail in connection with Gogri P.S. Case No. 363 of 2019 dated 21.10.2019 instituted for the offences under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 22.12.2020 and charge-sheet has been submitted in the case.
Learned counsel for the petitioner submits that allegation is of forcibly snatching a bag containing Rs. 8,74,395/- on point of pistol by two accused persons in the age group of 25-30 years.
Learned counsel for the petitioner submits that the F.I.R. was against unknown and the name of the petitioner
Patna High Court CR. MISC. No.38264 of 2021(2) dt.13-12-2021 2/3 transpired in the case during the course of investigation based on the fact that spies of the police have claimed to identify the petitioner in C.C.T.V. footage. Learned counsel further submits that though it is claimed that this petitioner was identified in C.C.T.V. but no C.C.T.V. footage was brought on record during the course of investigation nor the petitioner was put on T.I.P. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 22.12.2020 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of Pallavi Anand, learned J.M. 1st Class, Khagaria in connection with Gogri P.S. Case No. 363 of 2019 subject to the condition as laid down under Section 437 (3) Cr.P.C. with a condition that the petitioner will continue marking his attendance in the concerned police station in between 20th to 25th of every month commencing from January, 2022 till framing of charges and in the event it is reported by the concerned police station to the learned court below that the petitioner in between the aforesaid dates has not marked his attendance in any of the
Patna High Court CR. MISC. No.38264 of 2021(2) dt.13-12-2021 3/3 month till framing of charges, the court below shall be at liberty to cancel his bail bonds.
