Petitioners apprehend their arrest in connection with Manihari P.S. Case No.05 of 2021, registered for the offences punishable under Sections 341, 323, 324, 307, 354, 504, 506 and 34 of the Indian Penal Code.

Petitioners are said to have assaulted the informant and her son by means of spade causing injuries to them. It is also alleged that petitioner, Pintu Yadav tried to outrage the modesty of the informant.

Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the

Patna High Court CR. MISC. No.28424 of 2022(3) dt.15-05-2023 2/2 present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the injuries sustained by the injured persons are simple in nature.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Perused the records including the case diary. It appears from perusal of the injury report annexed with the case diary that the injuries sustained by the injured persons are simple in nature.

Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Manihari P.S. Case No.05 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
