The application is for grant of bail for the offence under Sections 272 and 273 of the Indian Penal Code as well as Section 47 (A) of the Bihar Excise (Amendment) Act, 2016. It has been submitted on behalf of the petitioner that it is alleged by the police that four bottles of liquor has been recovered from the 'Dickey' of the Motorcycle of the petitioner, however, the FIR itself shows that the said Motorcycle was parked somewhere and the police seized the vehicle and got it taken to the Police Station and four bottles of liquor was recovered. The petitioner has no criminal antecedent. There is no compliance of Section 100 of Cr.P.C.

Having heard both sides and in view of the facts as stated above, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Gaya in connection with Vishnupad Police Station Case No.96 of 2016.
