JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-11-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Bath P.S. Case No.98 of 2017 registered under Sections 341, 323, 307 and 506/34 of the Indian Penal Code and Section 25(1-B)a/27 of the Arms Act.

At the outset, it is submitted by the learned counsel for the petitioners that during the pendency of the application the petitioner no.2 Basuki Kumar has already been arrested. In that view of the matter, the application for grant of pre-arrest bail of petitioner no.2 Basuki Kumar is dismissed as

So far as the other two petitioners, namely, Muso Kumar @ Bambam Kumar and Prabha Devi are concerned, in view of the injuries caused to the informant having been found simple and superficial, in the event of arrest or surrender before the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIII, Bhagalpur in connection with Bath P.S. Case No.98 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
