JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Udakishunganj P.S. Case No. 145 of 2016 registered under Section-30(a) of the Bihar Excise Act, 2016.

The alleged recovery is said to have been made from the house of co-accused and so far as the petitioner is concerned; except confidential information, there appears to be nothing against him. Moreover, the first information report goes to show that the house of the petitioner was too raided but nothing was found in the house of the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory

Patna High Court Cr.Misc. No.54651 of 2016 (2) dt.11-01-2017 2/2 bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Udakishunganj P.S. Case No. 145 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, District-Madhepura subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
