JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 29-01-2021 Heard Mr. Ajay Kumar Sinha, learned counsel for the petitioner and Mr. Jharkhandi Upadhyay, learned Additional Public Prosecutor (hereinafter referred to as the 'APP') for the State.

2. The petitioner apprehends arrest in connection with Barauni (Garhara) PS Case No. 71 of 2020 dated 19.02.2020, instituted under Section 366A of the Indian Penal Code.

3. The allegation against the petitioner along with others is of abducting the minor daughter of the informant with the intention of marriage.

4. Learned counsel for the petitioner submitted that she is only co-villager of Amarjeet Kumar, who has married the girl. Learned counsel submitted that he has filed supplementary affidavit and drew the attention of the Court to the statement of the girl recorded under Section 164 of the Code of Criminal Procedure, 1973, in which she has stated that she has married Amarjeet Kumar and now they are living in Jodhpur. Learned counsel submitted that the petitioner besides being a lady has no criminal antecedent.

5. Learned APP submitted that the allegation is of abducting the minor daughter of the informant.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Barauni (Garhara) PS Case No. 71 of 2020, subject to the conditions laid down in

Patna High Court CR. MISC. No.28108 of 2020 dt.29-01-2021 3/3 Section 438(2) of the Code of Criminal Procedure, 1973 and further, that one of the bailors shall be a close relative of the petitioner.

7. The application stands disposed off in the aforementioned terms.
